California said yes to marijuana during the recent presidential election, but your employer doesn't have to.
Proposition 64 made it legal for adults over the age of 21 to use and grow marijuana for personal use in the state of California starting Nov. 9.
The sale and taxing of marijuana doesn't go into effect until Jan. 1, 2018.
However, the new law clearly states private and public employers are still allowed to create and enforce their own policies regarding marijuana use.
This means, the employer has the right to drug test employees and the right to refuse to hire an individual over marijuana use if it's against company rules. They can also terminate an employee for using marijuana- both on and off the job- if it's against stated policy.
Since Prop 64 gives employees the freedom to choose their marijuana policy, specific questions about what's allowed in the workplace should be addressed to an employer.
