Judge tentatively blocks injunction to halt Sacramento arena

A Sacramento judge has tentatively denied a petitioner' motion for a temporary injunction to halt construction of a sports and entertainment complex in downtown Sacramento.

In issuing the ruling, Sacramento Superior Court Judge Timothy M. Frawley wrote the petitioner did not meet either of two statute requirements for injunctive relief: that the project constitutes an imminent threat to public health and safety or "that [the] arena site contains unforeseen important Native American artifacts or unforeseen important historical, archaeological, or ecological values that would be materially, permanently, and adversely affected by the continued construction or operation of the downtown arena."

Petitioners argued the statute is unconstitutional.

Construction on the project is scheduled to begin this summer.

A court hearing is set for Friday.
