'Verbal agreement' reached in settlement between family of Stephon Clark, city of Sacramento

The exact terms of the settlement have been sealed by the court. The City still has to approve the terms before anything can be finalized.

SACRAMENTO, Calif. — The family of Stephon Clark has reached a verbal agreement on a settlement with the city of Sacramento, according to federal court documents.

“After discussions with the Court, parties reached a verbal settlement as to the claims against defendants brought by A.C., C.C., and their guardians, subject to Sacramento City Council approval,” the court documents read. The initials "A.C. and C.C." represent Clark's sons, whose names were withheld because of their ages.

The exact terms of the settlement have been sealed by the court. The City still has to approve the terms before anything can be finalized.

The federal lawsuit was filed on behalf of Stephon Clark's two sons, his parents and his grandparents. It contended that officers used excessive force and that Clark was a victim of racial profiling. The family was seeking more than $20 million in damages.

Clark was shot seven times on March 18, 2018, and his killing prompted protests in Sacramento and across the U.S. Police said Clark was facing officers when he was killed, moving forward with his arms extended and an object in his hands. Officers said they thought Clark had a gun, but they only found his cell phone.

Sacramento County District Attorney Anne Marie Schubert announced on March 2 that no criminal charges will be filed against Sacramento Police Department officers Terrance Mercadal and Jared Robinet for the shooting death of Stephon Clark.  

On March 5, California Attorney General Xavier Becerra released his report, also declining to press criminal charges against the officers.
