Suspect in deadly officer-involved shooting accused of beating, stealing elderly man's cane

According to authorities, the suspect allegedly assaulted an elderly man in his 70s, beating him and stealing his cane.

LINDA, Calif. — Update, January 16:

More details have been released about an officer-involved shooting on Monday, Jan. 14. 

The shooting happened around 3:30 p.m. on N. Beale Road, between Avondale and Lowe avenues in the small town of Linda, according to the Yuba County Sheriff’s Department. 

The first deputy on scene made contact with the suspect, Jahmal Derrick Stewart, shortly after the robbery of an elderly man. He asked Stewart to remove his hand from his coat pocket so he could begin a pat-down, but as soon as the pat-down began Stewart pulled away and tried to run off. 

The deputy attempted a control hold on Stewart, but Stewart got violent — even grabbing the deputy’s holstered weapon. Because he was much larger than the deputy, it was an intense struggle until another deputy arrived. 

While the deputy and suspect continued to struggle, a backup deputy arrived. As he approached the fight he said he heard, "He's got my gun!"

Both deputies reported that they then heard one shot fired from the weapon that the suspect had been trying to un-holster. 

After hearing that shot, the backup deputy — who was standing a few feet away — fired between three and five shots, killing 45-year-old Stewart. 

Deputies interviewed several people who witnessed the fight. They confirmed that Stewart had been trying to grab the deputy's weapon during the struggle. 

"Due to the type of holsters carried by our deputies, a duty weapon will not fire when fully holstered; leading us to believe that the suspect had successfully taken the weapon far enough out of the holster for the duty weapon to fire," the department said in a statement.

An investigation confirmed that Stewart had an active felony, no bail warrant out of Sacramento and was on active PRCS Probation for various weapons violations. Stewart has spent time in prison for multiple felony convictions and has a history of violence including child abuse, domestic violence, aggravated assault, and multiple arrests for resisting arrest and battery on a peace officer.

The two deputies involved, one with 16 years as a peace officer and the other with three years of service, have been placed on paid administrative leave pending the outcome of the investigation. 

An autopsy scheduled for Jan. 17 will list the official cause of death, including how many time times and where Stewart was shot. 

The investigation is ongoing.

Update, January 15:

The suspect in a deadly officer-involved shooting in Yuba County has been identified as 45-year-old Jahmal Derrick Stewart.

According to authorities, Stewart allegedly assaulted an elderly man in his 70s, beating him and stealing his cane. 

Police say the victim did not know Stewart and the attack appears to be random.

The events that followed, including the shooting, remain under investigation.

A man who allegedly assaulted someone Monday afternoon was shot and killed by deputies in a small Yuba County town, sheriff's officials said.

According to the Yuba County Sheriff’s Department, the shooting happened just before 4 p.m. on N. Beale Road, between Avondale and Lowe avenues in the small town of Linda.

Deputies were responding to an assault in the area where a caller said they witnessed one man was beating another man with some kind of weapon. When officers arrived they spotted a person matching the suspect's description. 

It is unclear what happened next or what prompted the officers to open fire. 

The suspect, who has not yet been identified, was pronounced dead at the scene. Authorities tell ABC10 a deputy and the victim of the original assault call were treated for minor injuries at the scene.

The two deputies involved in this incident have been placed on routine administrative leave while an investigation is conducted.
