Three people arrested for shooting death of 5-year-old in Modesto

5-year-old Xavier Smith and another boy were playing inside a home when someone began shooting outside.

Three people have been arrested in connection to two Modesto homicides, including the shooting death of a 5-year-old boy.

According to police, on October 28, 2017, 5-year-old Xavier Smith and another boy were playing inside a home in Lake Park Court. Smith was killed when someone began shooting at the home. Detectives do not believe the two boys were the intended target, but unfortunately got caught up in the crossfire of a shooting motivated by drugs.

Less than a month later, on November 21, Cody Lea was shot and killed near Ustach Park. Police say drugs were also the motive behind Lea's death.

Santa Crus Police arrested Robert Davis, 21, at a motel late Friday night. Investigators believe Davis was the shooter in both homicides.

Modesto Police arrested Davis' alleged accomplices Ryan DeSousa, 20, and David Wilmore, Jr., 21, Friday morning.

“Detectives have worked tirelessly over the last several months to bring justice to the families of these two young victim," Sergeant Steve Hinkley of the Violent Crimes Unit said. "With the collaborative assistance of the community, Stanislaus County Sheriff’s Office, Stanislaus County District Attorney’s Office, Homeland Security Investigations, and the California Highway Patrol, we were able to make these arrests. We would like to thank the families of the victims and the community for their patience and understanding during this difficult process.”
