Man shot during K Street shooting called to testify in preliminary hearing

The judge granted him immunity as he testified in court, but he said he couldn’t recall most of what happened that night when prosecutors asked him questions.

SACRAMENTO, Calif. — The suspects in the deadly K Street shooting were back in Sacramento County Superior Court Thursday as their preliminary hearing continues.

The April 2022 shooting left 12 people wounded and six dead.

On Thursday, Oshe White was called to the stand. He was downtown the night of the shooting and was shot twice.

The judge granted him immunity as he testified in court, but he said he couldn’t recall most of what happened that night when prosecutors asked him questions. 

In court, Brad Ng with the Sacramento County District Attorney's office asked White, "Does it matter what question I ask about this evening. Are you going to answer every question with, 'I don't recall?'"

"Honestly sir, I've been through so much in the last two years from being homeless, from being on the streets and with this pole in my leg and this bullet in my spine, I have completely tried to dismiss everything that has happened from the last 3 to 4 years," White replied.

In a bodycam recording of a hospital interview played in court, White told the lead detective about a confrontation outside Sharif Jewelers on 10th and K before shots were fired.

In the interview, White said a man with a gun in a 'Backwoods' sweatshirt started questioning him.

"The dude stopped me and was like, ‘What you looking at,’ and I was like, ‘I'm looking for my cousins.’ After that he was like, ‘Where are you from?' 'I'm from the north but I don't bang,’" White said in the interview.

At the time, White identified the man as suspect Smiley Martin, but he said in court he couldn’t remember.

White is expected to return to the stand Monday morning. The judge put a pause on his testimony, saying a legal issue came up.

The three suspects, Mtula Payton, Smiley Martin and Dandrae Martin, face murder charges in connection with the shootout Sacramento police say was gang-related.

The preliminary hearing will determine if there's enough evidence for the case to go to trial. 

Sacramento County Superior Court said additional testimony will be heard in August.
