Man shot by police in Tracy allegedly tried to run over two officers during burglary

The suspect was the only person hit by gunfire during the shooting, but police said three other people were in the SUV.

TRACY, Calif. — The suspect shot by Tracy police was allegedly trying to run over two officers after a burglary.

The Tracy Police Department released new details after a call regarding a burglary led to police shooting one of the suspects. The burglary was reported around 3:30 a.m. on Nov. 19 at the Best Buy Warehouse along Hopkins Road.

Multiple suspects were trying to break into trailers parked at the warehouse when at least two suspects ran away and led police on a brief chase. Not long after, they confronted the suspect, and police opened fire.

According to an updated news release from police, Sergio Garibay, 49 of Oakland, tried to run over two officers with a SUV, an Infiniti QX80, to avoid being caught. Police said the same car had been reported stolen by the San Jose Police Department

Garibay was the only person hit by gunfire during the shooting, but police said three other people were in the SUV.

Garibay was hospitalized in critical but stable condition. He is expected to be booked into the county jail on suspicion of assault with a deadly weapon on a peace officer, burglary and conspiracy.

Also arrested was Brenda Prado, 27 of Oakland, on suspicion of burglary and conspiracy and Jose Aguilar, 36 of Oakland, on suspicion of burglary, conspiracy and obstruct/resist/delay of an officer.

The fourth suspect in the burglary escaped.
